Defence of Civil Fraud
Clarke Barnes have substantial experience acting for Defendants and Claimants in contentious High Court and County Court proceedings where allegations of dishonesty, corruption, insider dealing or fraud have been alleged. Often such actions commence with applications to the Court to freeze assets, to enter premises to search for goods or documents, or to require immediate disclosure of certain facts or the whereabouts of property or funds. Our solicitors have experience in obtaining Court Orders and in defending them, and can offer guidance on how to comply or challenge such orders.
Often Court Orders come with Penal Notices whereby the Claimant will seek an Order for imprisonment if there is a failure to comply with the obligations of the Order. These can be stressful and expensive proceedings and we recommend seeking expert guidance. We have been advising our clients for the last twenty years and have an in-depth and practical knowledge of how such claims work and the procedures and tactical steps which can be taken to avoid the many difficulties associated with confrontational litigation.
